1. Religious Identity – Moslem Trust
The Amare Bey Family Trust is a Moslem religious trust and ecclesiastical body, organized for charitable and spiritual purposes consistent with the Holy Koran of the Moorish Science Temple of America and protected under the First Amendment of the U.S. Constitution.
As Moslems, our religious practices and organizational structure are governed by divine law, private religious law, and the ecclesiastical jurisdiction of our faith.
2. 508(c)(1)(A) Legal Exemption
We operate lawfully under 26 U.S.C. § 508(c)(1)(A), which provides automatic tax-exempt status to churches, their auxiliaries, and integrated religious organizations.
This includes Moslem religious trusts.
“Churches, their integrated auxiliaries, and conventions or associations of churches are excepted from filing Form 1023 to be recognized as tax-exempt.”
– IRS Publication 1828
We are therefore not required to apply for 501(c)(3) status or IRS pre-approval. Our exemption is inherent under federal law.
3. Supporting Federal Case Law
Ashley v. Commissioner, 72 T.C. 76 (1979):
The U.S. Tax Court confirmed that religious organizations, including churches and ecclesiastical bodies, are not required to file Form 1023 to obtain tax-exempt status under 501(c)(3). They are automatically exempt under § 508(c)(1)(A).
This case supports our Moslem Trust’s self-executing religious exemption and affirms our right to operate without federal interference.
